Data protection

Introduction

We, the Fehr Group AG, as the operator of the online offer, are responsible for the processing of the personal data of the users of the online offer. Our contact details can be found in the imprint of the online offer, the contact persons for questions concerning the processing of personal data are mentioned directly in this data protection declaration. We take the protection of your privacy and your private data very seriously. We collect, store and use your personal data only in accordance with the content of this privacy policy and the applicable data protection regulations. With this data protection declaration, we inform you to what extent and for what purposes personal data is processed in connection with the use of the online offer.

Personal data

Personal data is information about an identified or identifiable natural person. This includes all information about your identity, such as your name, e-mail address or mailing address. However, information that cannot be associated with your identity (such as statistics, such as the number of users of the online offer) is not considered personal data. In principle, you can use our online offer without disclosing your identity and without providing personal data. We will then only collect general information about the visit to our online offer. For some of the services offered, however, personal data is collected from you. This data will then be processed by us in principle only for the purpose of using this online offer, in particular for providing the desired information. When collecting personal data, only those data that are strictly necessary must be provided. In addition, further information may be possible and may be voluntary. We would like to point out whether these are mandatory fields or voluntary information. We will then inform you about the specific details in the corresponding section of this data protection declaration. Automated decision-making based on your personal data does not take place in connection with the use of our online offer.

Processing of personal information

We store your data on specially protected servers within the European Union or Switzerland. These are protected by technical and organizational measures against loss, destruction, access, modification or dissemination of your data by unauthorized persons. Access to your data is only possible for a few authorized persons. These are responsible for the technical, commercial or editorial support of the servers. Despite regular inspections, however, complete protection against all dangers is not possible. Your personal data is transmitted over the Internet in encrypted form. We use for data transmission.

Disclosure of personal data to third parties

We only use your personal information to provide the services you request. Insofar as external service providers are used by us in the context of the provision of services, their access to the data also takes place exclusively for the purpose of the provision of services. Through technical and organizational measures, we ensure compliance with data protection regulations and also oblige our external service providers to do so. In addition, transmission to third parties takes place only with your express consent or to the extent that we are entitled or obliged to do so on the basis of legal provisions and/or official or judicial orders. In particular, this may involve providing information for law enforcement, security or enforcement purposes. Insofar as we transfer your personal data ourselves or through service providers in countries outside the European Union, we comply with the applicable legal requirements and also oblige our service providers to comply with these. We will therefore only transfer your data to countries outside the European Union or Switzerland, as long as the legally prescribed level of protection is observed. This level of protection is ensured in particular by an adequacy decision of the EU Commission or the Swiss Federal Council or by appropriate guarantees in accordance with the applicable legal provisions.

Legal bases of data processing

We do not need a legal basis for all of our data processing. To the extent that we require such a measure due to the applicable laws, we will explain to you in this section what it consists of. References to these legal bases in the remainder of the Privacy Policy only refer to the case in which we need such a basis under the applicable laws. Insofar as we obtain consent for the processing of your personal data, this consent is the legal basis for the data processing. Insofar as we process your personal data because this is necessary for the fulfillment of a contract or within the framework of a contract-like relationship with you, the fulfillment of the contract or pre-contractual measures constitutes the legal basis. Insofar as we process your personal data for the fulfillment of a legal obligation, this constitutes the legal basis for the data processing. As a legal basis for the data processing, processing on the basis of legitimate interests can also be considered if the processing of your personal data is necessary to safeguard our legitimate interests or the interests of a third party and your interests, fundamental rights and freedoms do not require the protection of personal data. Within the context of this data protection declaration, we point out in each case on which legal basis we base the processing of your personal data, insofar as legally necessary.

Data erasure and storage time

We always delete or block your personal data whenever the purpose of the storage no longer applies. However, storage can also take place if this is provided for by legal requirements to which we are subject, for example with regard to statutory retention and documentation obligations. In such a case, we will delete or block your personal data after the end of the relevant requirements.

Use of our online offer

Information about your computer

Whenever we access our online offer, we collect the following information about your computer, regardless of your registration: the IP address of your computer, the request of your browser and the time of this request. In addition, the status and the amount of data transferred are recorded within the scope of this request. We also collect product and version information about the browser and operating system used on the computer. We further record from which website the online offer was accessed. The IP address of your computer is stored only for the time of use of the online offer and subsequently deleted or anonymized by truncation. The remaining data shall be stored for a limited period of time. We use this data for the operation of the online offer, in particular to detect and eliminate errors, to determine the utilization of the online offer and to make adjustments or improvements. These purposes are also our legitimate interest in data processing.

Use of cookies

As on many websites, cookies are used for our online offer. Cookies are small text files that are stored on your computer and store certain settings as well as data for the exchange with the online offer of us via your browser. A cookie usually contains the name of the domain from which the cookie file was sent, information about the age of the cookie, and an alphanumeric identifier. Cookies enable us to recognize your computer and make any preferences and preferences immediately available. The cookies used by us are – as far as possible – so-called session cookies, which are automatically deleted after the end of the browser session. In some cases, cookies with a longer storage period can also be used so that your preferences and preferences can be taken into account the next time you visit our online offer. Most browsers are set to accept cookies automatically. However, you can disable the storage of cookies or set your browser to notify you when cookies are sent. It is also possible to manually delete already stored cookies via the settings of the browser. Please note that you may only be able to use our online offer to a limited extent or not at all if you refuse the storage of cookies or delete necessary cookies. Insofar as cookies are not required for our online offer, we ask you for consent to the use of cookies when you first call up the online offer. With regard to the non-necessary cookies of third-party providers, you will find below a more detailed description of the services of these third-party providers used by us. The legal basis for the associated data processing, including any data transfer, is your consent. Once consent has been given, it may be revoked at any time with effect for the future, in particular by changing the selected settings. The legal basis for the use of necessary cookies is our legitimate interest in the proper provision of our online offer and – insofar as contracts are concluded or fulfilled via our online offer – the fulfillment of the contract or pre-contractual measures. Once a selection has been made with regard to the use of cookies, it can be changed again at any time.

Integration of third-party services

For some features in our online offering, we use third-party services. The corresponding services are mainly optional functions that must be explicitly selected or used by you. We have entered into contractual agreements with the respective providers to provide or integrate their services and as far as we are able to ensure that the third-party providers also inform transparently about the scope of the processing of personal data and comply with data protection regulations.

Google Tag Manager

For our online offer we use the Google Tag Manager of Google Ireland Limited, Gordon House, 4 Barrow St., Dublin, D04 E5W5, Ireland ("Google"). The Google Tag Manager is a tag management system (TMS) that allows tags, i.e., tracking codes and related code fragments, to be managed on our website. Google services can be integrated into a website via Google Tag Manager. When using the Google Tag Manager, a connection to the Google servers is established. As a result, the IP address of the browser of the terminal device used by the visitor to these Internet pages is stored by Google. In this context, it is not excluded that data may be transferred to Google in the USA and that US security authorities may be able to access the data. However, cookies are not set in connection with the use of the Google Tag Manager. For more information on the Google Tag Manager and the data processing by Google, please visit: https://support.google.com/tagmanager/answer/6102821?hl=de https://www.google.com/policies/privacy/ Our legal basis for the use of the Google Tag Manager is our legitimate interest. Our legitimate interest is the management of the tracking codes in our online offer, which enable us to analyze the use of our online offer and to improve and personalize our services.

Google Analytics

We use Google Analytics for statistical evaluations. Google Analytics is a web analysis service from Google. As part of Google Analytics, Google uses cookies, among other things, for the evaluations. The type and scope of the use and evaluation of cookies are determined by Google. The information about your use of the online offer generated by the cookies is transmitted to a Google server and stored there. This does not preclude the possibility that data may be transferred to the USA and that, as a result, public authorities may have access to this data. However, standardized IP anonymization means that your IP address will be truncated by Google beforehand on servers in the European Union or Switzerland. On our behalf, Google uses this information to evaluate your use of the online offer, to compile reports on website activities and to provide other services related to website use and internet use to us as the operator of the online offer. In addition, Google may use the data for its own purposes. Within the scope of these purposes, Google, for example, forms a profile on the user behavior or links the data with other data, for example with an existing Google account. We have no influence whatsoever on these data processing operations. According to Google, the IP address transmitted by your browser as part of Google Analytics will not be combined with other data that Google collects or already has. For more information, please refer to Google's data protection information, which is linked for you below. We also use the "demographic features" function of Google Analytics. This enables reports to be produced that contain statements about the age, gender and interests of the website visitors. This data comes from interest-based advertising from Google as well as from visitor data from third-party providers. You can deactivate this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as shown in the following paragraph. For more information on the demographics feature, please visit Google at https://support.google.com/analytics/answer/2799357?hl=de. You can prevent the collection of the data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plug-in available under the following link http://tools.google.com/dlpage/gaoptout?hl=de. For more information, please visit http://tools.google.com/dlpage/gaoptout?hl=de or http://www.google.com/intl/de/analytics/privacyoverview.html (general information on Google Analytics and data protection). Please note that on our website Google Analytics has been extended by the code "anonymizeIp();" in order to anonymize the IP addresses, whereby the last octet will be deleted.

Use of YouTube

Our online offer includes YouTube videos, for which we use a plugin of the Google-operated service YouTube ("YouTube"). The operator of the service is Google. We use the YouTube service in the extended data protection mode to protect your privacy as much as possible. When you access a website of our online offer on which a YouTube video is embedded, Google initially receives only the information necessary for integration and no cookies are set for usage analysis. Google will only receive further information when you play the embedded video; Google may also set cookies to analyze your user behavior. When the video is played, Google's YouTube servers are informed, for example, about which page of our online offer you play the video. If you are logged into your Google account, you enable Google or YouTube to directly associate your browsing behavior with your personal Google profile. We therefore recommend that you only play embedded YouTube videos if you agree with the associated data processing by Google. You can prevent the data association to your Google profile by logging out of your YouTube account. For more information on how to handle user data, please see Google's privacy policy at https://www.google.de/intl/de/policies/privacy/, which also applies to YouTube. We use YouTube so that we can show you videos and thus better inform you about us and our services. The legal basis for the integration of the videos is our legitimate interest; however, the playback of the videos and the associated further data processing are only carried out on the basis of your consent.

Applicant Portal

You can apply for a position with us via the applicant portal and submit all the necessary information and documents. The use of the applicant portal is voluntary; you can also send us your application by other means, for example by e-mail or post. Upon receipt of an application via the applicant portal, your documents will be forwarded electronically to the relevant employees at our company. If you have applied for an advertised position, the documents will be automatically deleted three months after the completion of the recruitment procedure, unless any other legitimate interests preclude deletion. Such legitimate interests in this sense are, for example, evidentiary obligations in a procedure under the German General Equal Treatment Act (AGG) or the Swiss Equal Treatment Act (GlG). In the case of an application without reference to a job advertised (unsolicited application), the application is retained as long as there is a possibility that the application may be of interest. You have the possibility at any time to request the deletion of your application even before the expiry of the prescribed retention periods. In the event of a successful application, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the legal requirements. In all other cases, the legal basis for storing your applicant data is your consent.

You can decide for yourself what information you will provide to us via the contact form. The legal basis for processing your data is your consent. After the matter has been processed by us, the data will be stored first in the event of any queries. Facebook: https://www.facebook.com/policy.php LinkedIn: https://de.linkedin.com/legal/privacy-policy No personal information is transmitted to the respective providers before the corresponding links are called up. Your access to the linked page is also the basis for data processing by the respective provider. In addition, the following information on the associated processing of your personal data applies to our use of the social media channels Facebook and Instagram.

In addition to our own online offer, we also run a fan page on the social network Facebook. The fan page provides information about our activities and offers a channel for communication. The operator of the Facebook social network is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (‘Meta’). To this extent, we use the technical platform and the services of Meta.

Delimitation of responsibility

We point out that you use the fan page and its function under your own responsibility, especially with regard to interactive functions such as commenting, sharing or evaluating. Alternatively, you can also access the information offered via the fan page on our homepage. As far as possible on Facebook, we try to ensure the protection of your privacy and your private data. If your personal data is processed in connection with the us visiting the fan page, the explanations in this data protection declaration apply without restriction. Due to the integration of the fan page into Facebook's offer, it should also be noted that personal data is processed by Meta at the same time. When visiting the fan page, Meta collects, among other things, your IP address and other information that may be stored in the form of cookies on the terminal device you use or in the respective browser. We have no influence on the processing of data by Meta; Facebook in particular does not act as a processor for us under our responsibility. Facebook's data processing policies apply – at least according to Meta's statements – to Facebook's policies, which can be accessed at https://de-de.facebook.com/policy.php. We point out that the data collected about you by Meta in this context may also be transferred outside the European Union or Switzerland. In terms of data protection law, we and Meta are jointly responsible for the operation of the fan page or the evaluation of user data when visiting the fan page. In accordance with the data protection regulations, we have concluded an agreement with Meta to delimit responsibility internally.

Facebook Insights

Meta offers the operators of fan pages the opportunity to obtain an overview of the use of the fan page and its users via the functions of page insights. Above all, statistical data can be accessed and evaluated via page insights. We use the data from site insights to make the fan page as attractive and efficient as possible. To this end, Meta provides us with data generated by Meta itself. Facebook provides further information on the functioning and responsibility for the Page Insights function at https://www.facebook.com/legal/terms/page_controller_addendum.

Users who are registered with Facebook also have the opportunity to communicate directly via Facebook Messenger. If you contact us via the Messenger, the transmitted data will be stored and used by us exclusively for the purpose of answering your inquiry. The legal basis for processing your data is your consent and our legitimate interest. Our legitimate interest lies in the collection and processing of customer inquiries, in the evaluation of customer inquiries and the control of abuse. The data will be deleted as soon as they are no longer necessary for achieving the purpose for which they were collected. For your personal data, this is the case when the respective conversation has ended. For us, the conversation ends when it can be inferred from the circumstances that the facts in question have been finally clarified. You have the possibility to revoke your consent to the processing of personal data at any time; in this case, the data will be deleted by us immediately if there is no basis for further storage.
